Terms of Service

1. Legal Entity & Agreement

Hooksend is operated by Hooksend Software, registered under Udyam (Ministry of MSME, Government of India).

By accessing or using our Service at https://hooksend.in, you represent that you are at least 18 years old and have the legal capacity and authority to enter into these Terms on behalf of yourself or your organization.

2. Account Registration & Security

• You must provide accurate, current, and complete information during registration.
• You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You agree to notify us immediately at support@hooksend.in if you suspect any unauthorized access or breach of security.

3. Authorized Instagram Account Connection

You may only connect Instagram Professional (Business or Creator) accounts that you legally own or for which you have explicit, documented authorization from the account owner. You must not attempt to connect or manage third-party Instagram accounts without proper consent.

4. Strict Compliance with Meta Policies

Hooksend connects exclusively through official Meta APIs (Instagram Graph API, Instagram Webhooks). You explicitly agree to comply with all applicable Meta policies:

• Meta Platform Terms & Developer Policies: You will not use the automation to send deceptive, spammy, or unsolicited bulk messages.
• Instagram Community Guidelines: Content delivered via auto-DMs must not violate Instagram's community standards or intellectual property rules.
• 24-Hour Messaging Window: You acknowledge that private DM replies are delivered only in direct response to user-initiated comment triggers, strictly within Meta's permitted response windows.

5. Prohibited Uses

You agree NOT to use Hooksend to:

• Distribute illegal, defamatory, obscene, pornographic, fraudulent, or harassing content.
• Conduct phishing, deceptive financial schemes, malware distribution, or credential harvesting.
• Send repetitive automated messages to users who have not opted in or commented trigger keywords.
• Attempt to circumvent Meta's rate limits, our internal sliding-window throttles, or security controls.
• Reverse-engineer, decompile, or copy the platform architecture or source code.

Violation of these rules will result in immediate termination of your account without prior notice.

6. Service Availability & API Dependency

Hooksend operates on cloud infrastructure and integrates with third-party platforms (including Meta Platforms, Inc.). While we strive for 99.9% uptime, we do not guarantee uninterrupted or error-free operation. We are not liable for downtime, API deprecations, rate limiting, or service modifications imposed by Meta.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Hooksend, its founder, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, revenue, or business reputation arising out of or related to your use of the Service.

8. Termination & Suspension

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without liability, if you breach these Terms or if your usage poses a security, legal, or reputation risk to our platform or other users.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in India.
